Chancel Repair Liability: An Introduction

Over the past few years, a small team at the Church Commissioners have been undertaking the task of researching chancel repair liabilities that fall within the Church Commissioners' responsibility; around 800 chancels in total. This project started as a result of the Land Registration Act (LRA) 2002 (and the Transitional Provisions (No. 2) Order 2003), whereby chancel repair liability based on land will cease to apply on the first sale of land post October 2013 if the liability is not registered by then or where a caution against first registration has not been placed at the Land Registry against unregistered land.

This website is primarily a reference tool for Parochial Church Councils (PCCs) whose chancel liabilities the Commissioners accept a repairing liability for or have done so in the past. It also contains the summary documents that have been created during this research project, grouped by diocese. You will find a spreadsheet that simply apportions the percentage of the liabilities, most often based on the Record of Ascertainments (which will also be found here) in tithe based cases. In some cases, where, for example, the Commissioners have sold land but retained the liability, there may be a map of the affected area for the PCC to register in accordance with the LRA 2002.
